Dear Blumenthal & Markham:
I've received your Claim form for Allec v. Cross Country Bank
Unfair Business Practices -- Deceptive Advertising, Orange County Superior Court Case no. 802894 Department 67. The final hearing will be held on Sep. 30, 2002. Ongoing cardholders and former paid-off cardholders must submit claim form to Cross Country Bank Claims Administration by Oct. 31, 2002 in order to obtain Settlement Benefits (Not exceed a maximum of $2,500 for any single plaintiff ).

My question is that if I submit this claim to apply for settlement benefits in this lawsuit, do I still get to sue Cross Country Bank EXTRA??
I like to sue Cross Country Bank EXTRA for their "Malicious Collection Practices Act by constantly intimidatory, harassing me by mails and phone. Calling my house over year, then calling my new job office and hog the line everyday after I warned them "I'm suing you if you keep harass me for your credit card I never received" until my ex-boss warned me "improve your office behaviors or else leave the job". I lost the job and try to sue Cross Country Bank for damages of my job' credit report and my health.
I have all the detail post at
http://www.crosscountrycard.com/CrossCountry.htm
Would you take my case and represent me ?!
We also have lot of victims of Cross Country Bank posting their complaints on our web
http://www.crossCountryCard.com
Please let me know if you are willing to take our case.
We will post your information if you willing to present the other Cross Country Victims too.

Dear CapitalOne victims: You may think your story with CapitalOne is different, but let me tell you exactly what CapitalOne's been doing to every victim (YES! INCLUDING YOU!!): CapitalOne need to create all kind of traps and tricks to make you pay at least $500 on you account. Why? Because it cost CapitalOne at least $500 to get you become their CapitalOne NO-HASSLE card holder! You don't pay up to $500, they consider they lose money on your account! You won't get your credit limit increased! You won't get your account closed even you pay off the balance and cancel it. NO WAY! Another crucial trick that I need to tell you is: By law, you only allow to sue them for the current events occurred within ONE YEAR! Any trick CapitalOne got you, if it's over ONE YEAR, BINGO! it's FREE crime! CapitalOne will hold on it and keep charging on you FOREVER! Debt you to death. (The sad story is: In the first year, you always do your best to pay all the charges they trapped on you, you want to be a good cardholder so they will increase your credit limit, you want to pay all the fees they tricked on you so they won't post your credit report bad, and you never realized that by law you only allow to sue them in the first year! How much is your credit limit? $300 or $500? and how much  fees total they charged you in the first year?!)

Sue them NOW!! You only have ONE YEAR to sue these Out-Laws until they are Out-O'Businesshostmaster@CAPITALONE.COM , domainmgr@capitalone.com , webinfo@capitalone.com , hostmaster@COUNTRYWIDE.COM , webmaster@progressive.com, maverick@capitalone.com

Can the Media Help us?!

I wish to update you on a bill in Congress that has been advanced by corporate America, and, if enacted, will undermine the rights of consumers, employees and civil rights plaintiffs to bring and prosecute their claims in their communities.
The bill is numbered Senate Bill 274 and deceptively named the "Class Action Fairness Act." It is actually a cynical attempt to aid corporations under the disguise of class action "reform."
Senate Bill 274 is not fair to anyone but business defendants who don't want to be accountable to plaintiffs in state court. The bill would allow large corporations to remove virtually all class action cases filed in state court to federal district court and hand defendants numerous new procedural advantages over plaintiffs in federal court class actions.
It is expected that there will be a vote on the bill in the U.S. Senate in the near future. Today, please contact your Senators and urge them to OPPOSE Senate Bill 274. To do so, please click http://www.citizen.org/fax/background.cfm?ID=177&source=19 to visit the website of the non-profit organization Public Citizen. From this page, you will be able to send a fax free of charge to your Senators voicing opposition to the bill.
If you wish to learn more about class actions and Senate Bill 274, feel free to visit http://www.lieffcabraser.com/about.htm Over 400 corporate lobbyists have been aggressively pushing for the adoption of Senate Bill 274. These lobbyists, however, are no match for the will of citizens across America who are committed to protecting consumer, employee and civil rights.
I thank you for considering my request on this important issue.  Very truly yours, Stephen Cassidy

Dear Diane:
Thanks for your email.
I'm a victim of some major bad services, and therefore post these http://www.badServices.com http://www.capital1card.com ' http://www.crossCountryCard.com  over years.

Because I disputed their evil charges and fees and cancelled all of their credit cards, CapitalOneCard hided my payment checks 3 times (7/98/$666.79' $79.95' 10/98/$67.39) in 4 months, post me bad credit 32 times in 24 months, and scheduled to list my third card account report until year 2006 (second card they scheduled to list until 2005). My credit is so BAD that I could not even get any department store card! Cross Country Card gave me an offer "No credit or BAD credit? NO PROBLEM! $100 fee for Cross Country Card of credit limit $500".

Since it's my only chance to get a credit card, so I applied! It turn out to be $150 (after fees and charges or whatsoever) for a card I never see! I report the card must be lost and agreed to wait for second card. Then the nightmare started!! The bank harassed me to pay $300 (because I applied their card TWICE) so they might mail me a card? After I disputed them calling my home everyday, they got my new job number and called my new office everyday and hogging the phoneline, my boss finally told me "improve the office behavior or else leave the job".

I chose to leave the job and post these webs to fight these evil CapitalOneCard and stupid Cross Country Card.

Lots of victims post their complaints on these web everyday. And I keep wondering, when will we be heard? Cross Country Card is still doing their vampirism business in a name of Applied Card Systems !! Capital One Card changed their card into "No-Hassle Card" and started to air their TV commercial as "No-Hassle Card". They also pre-registered the web site domain name "noHassleCard.com" 10 years (so I wouldn't get the chance to post their new card ?!), but I figured out they do have "-" between "no" and "hassle", so I registered http://www.no-hassleCard.com and http://www.applyCardSystems.com .

I started http://www.CapitalOneCard.ca and http://www.CapitalOneCard.us because I also received the complaints from Canada and England UK. Yes! CapitalOneCard not only reach their business into auto-insurance' house loan, they are opening other countries! CapitalOneCard is the main reason why European hate US.
It's so great finally getting your email!!
I have too many information for you, so maybe it's better if we contact in email first.
I do have a database collection of these victims'' name' phone number' info of their complaints, and I post their complaints with first name base only, saving their personal info waiting for the situation of your concern.
My celephone is 323-***-****. But it never work in my new house, I can only call to check if anybody leave message everyday. Another example of bad services product.
Thanks and TALK TO YOU SOON!!

RE: PLANETFEEDBACK REFERENCE NUMBER 2067525

Dear Mr. Fairbank,

I'm writing to alert you to a problem I've had with a credit card issued by you. My problem concerns overall experience. I hope by bringing this to your attention, the problem will be addressed. This incident has made me extremely upset.

Here's what happened: I had a CapitalOne credit card account with a low credit limit. There is a discrepancy as to what my credit limit was.  CapitalOne has stated that my credit limit was $200 (which would mean I was only .94 over the credit limit), but CapitalOne has also stated it as being $201 (which would mean I was never over my credit limit).  I fell behind on a couple of payments due to work lay-offs.  However, I did resume payments.  I made numerous payments on my account--more than enough to pay for the principal balance as well as fees.  On numerous occasions my payments were not posted timely and I was penalized with late fees as well as continuous overlimit fees.  Additionally, the monthly payment requested was not sufficient to cover the fees that were charged (member fee, overlimit fee and late fee).  Once I realized this, I would add the various fees to my payment.  I noticed that although I made payments, the fees continued and the balance did not reduce None of the money I paid was ever applied to the principal amount charged.  Phone calls to "customer service" led to mounting frustration rather than solution.  Ultimately, I paid well over 3 times the principal amount charged.  I investigated further and discovered that the fees were being pyramided--which was illegal.  Once I discovered the illegal practice of pyramiding fees was taking place I ceased making any further payments.  When I requested the account closed, it was charged off shortly thereafter which revealed that the majority of the outstanding balance was fees and the principal balance remained untouched.  It was also reported to the credit reporting agencies that the account was closed at CapitalOne's request rather than mine.  I had attempted to get an itemized payment history from them, but was refused.  I have sought legal counsel regarding individual representation as well as inclusion in class action suits due to the mismanagement of my account and the illegal practice of pyramiding fees.

Anybody with similar experiences is welcome to contact me at js*@mychristianhost.com.  I am sure corroborating witnesses and evidence will be useful.

Here's what I want you to do: Zero out my balance and send letters to all three credit reporting agencies, with cc's to myself, directing them to update their records accordingly to remove any negative or detrimental ratings or comments regarding this account.

In the future, I will likely avoid doing business with CapitalOne .  And I definitely won't recommend CapitalOne to others.

I appreciate your taking the time to listen to my complaint. I hope it can be addressed.

Sincerely,
Jamie S* / js*@mychristianhost.com

Jamie, although u want to post the whole message complete, I still post your letter in first name basis only. I post my email address on my web, and I'm getting spoofing attacks because they learn that TV news want to interview us. (some viewer got virus infected spread the spoofing ) so it's better to keep your email in my dataBase' not post to public, or else you may get spoofing attack too. We r fighting the filthy wealthy evils, we had already signed and gave them enough info to attack and they can always add more damage when they see u r still fighting!!

The viewers who emailed me and still haven't see your message post today, please email me again. (please download the newest virusScan to clean your pc, it's infected with a newest worm, an unauthorized person can remotely download and run programs on your computer, stealing confidential information from you, or use your computer to send spam. ) Ever since I post the messages about TV news interview, I'm getting and fighting hundreds of spoofing spam every day, finally got it clean up until Sep.11, finally Jamie's email is fine to open. (Email me again! They don't want me to get your message, u just need to keep on trying. It did not surprise me when these spoofing spams strike  right after the TV news producer's message, I'm just amazed that we finally made my web virus free and the first email made it at Sep.11, somebody working on the web site must had done something helpful for this special date. If  u can never able to email me, u need to clean up your pc until it's worm free.)

This worm infects other computers by sending a copy of itself to all the e-mail addresses it finds on the infected computer. The worm then forges the sender's address by randomly selecting one of the e-mail addresses to pose as the sender. Because the worm on your friend's computer picked your e-mail address as the sender, you are receiving the messages from the recipient's Internet service provider informing you that the e-mail that you supposedly sent was rejected.

IF I AM GETTING THESE MAILER-DAEMON MESSAGES, AM I INFECTED WITH THE WORM?

Not necessarily. All it means is that your e-mail address was stored somewhere on an infected computer. You must update the virus definition file for your anti-virus software and then run an anti-virus scan of your computer to determine if you are infected with the worm.

The best way to remove the worm is to update your anti-virus software and run a complete scan of the hard drive. If your anti-virus software finds a virus, follow the vendor's instructions for removing the virus.

Tom, join the club!! I only  have one concern for your web: PLEASE DO NOT put any link to the blood sucking evil CapitalOneCard!! They are already spending million dollars airing  these demagogic TV commercials to dupe people getting their No-HassleCard. (I once called their TV commercials "Terrorist Attacks", damn, of course they are watching our webs all the time, now they change their attacking Terrorists into singing and dancing Mermaids and Party Girls!) Some viewers may click your link and eventually getting this indistinct card. Once you get the CapitalOnecard, there is NO way to pay off the balance and close their account! When you refuse their charges and fees and fight their bluff bluster, CapitalOne post your bad credit report and schedule to list over 7 years. (worse than a bankruptcy!) The damage and scar are life time forever! For the first time credit card holder's sake (they always getting CapitalOnecard without thinking twice), please DO NOT put any link to CapitalOneCard on your web!!

20 Aug 2003 17:24:30 / To: Media Relations /I have two CapitalOneCards. On Thursday Aug 14, I express overnighted a check drawn on a mortgage bank made out specifically to CapitalOne in the amount of $2,918 to pay off this card. This overnight envelope was signed for on August 15, as my due date was Aug 16th, I wanted to ensure that my credit stayed clean and the payment was applied. It is now Aug. 20 and the payment still has not been applied to my account. I have a signed receipt stating that CapitalOne received this express overnight package on the 15th, (see below) but Customer Service says there is no way they can check to see what was in the package, bulls*&^. "How do we know it was a check?" Come on, get real

For the other
CapitalOne card that I have (Carnival) I also sent another payment directly to them over a week ago, $992.on Wed, Aug 13th, and they are telling me they still have not received it.

I have spoke to two representatives about this issue and the only response I get is "well make another payment on line or phone it in for an addition $10". Chrissie Operator number 7682 was who I spoke to on 8/19.

What I find amazing about this is that the other 7 credit cards and two mortgages that I also sent checks to the same day have already been applied, only
CapitalOne is playing games and holding payment to ensure additional late fees. Sounds like CapitalOne is a huge scam.

I STRONGLY advise CARNIVAL CRUISE LINES line to really think twice before endorsing this company. I travel on Carnival quite frequently and this is giving me a sour taste in my mouth for both
CapitalOne and by affiliation, Carnival Cruise Line. I am a single Mom with two teenagers trying to get a head and games like this are uncalled for and truly deceptive in nature. You should be ashamed of yourselves.

The one in Southfield (also within 2 miles from my home) recently closed. That apparently was enough of an -excuse-to have CapitalOne enforce a $200.00 reduction in my $1000.00 credit limit, AND to dictate that I send them the predicted over-the-limit amount by the August 1st payment. This occurred last month. The warned me that if I didn't pay the minimum due, the predicted finance charge and the (soon to be) over-the limit amount that I could expect a $30.00 fee for being over the limit and a $30.00 late charge for not satisfying the August 1st deadline. I paid $60.00, 3 months in a row, for NOT knowing that my payments were not taking me far enough below the $1000.00 limit to prevent another over-the-limit charge. My bill climbed so high I had a hard time coming up with the $320.00 it finally took to GET me below my $1000.00 limit. Here's the worst part...I had not used the card for 3 months and thought I had successfully kept the balance below $1000.00! They're got  they're NEWLY-ENFORCED over-the-limit dollars today and the August 1st normal payment, and the predicted service charge for August and an extra $50.00 because I'm afraid of their trickery. 23 Jul 2003 19:04:21/ d. wright / djw*2@yahoo.com / 301-***-****/I am a card holder of CapitalOne. I have been trying got nine days to file a claim with payment protection. everytime, I would call they would give me the wrong information to file my claims. I even experienced on 7/22/03 where someone without my knowledge cancelled my payment protection insurance. I spent almost four hours on the telephone line speaking with payment protection trying to find out how and why someone was allowed to cancel my insurance. they could not give me a valid answer, instead they tried to say, it was cancelled by me the cardholder. they cancelled my payment protection insurance on the highest card balance without my knowledge. I have five credit cards through capital one bank and they all have credit protection insurance on them, why would I cancelled insurance on just one card? the reason, i pay payment protection insurance is to protect my self. I had no reason to contact the payment protection insurance prior to a couple of days ago in order to file a claim. they allowed someone to cancel my payment protection insurance in February of this year. they did not notify me of this fraulent activity on my account. they transferred my to be re-enrolled again in the payment protection plan. i should have never been dis-enrolled. I had to defend my self against  their mistakes. two of my credit card payments are due tomorrow and i still have not been able to file any claims. I spoke to someone again today and he agreed to sent me the claim forms through the mail. he told me to notify the credit card companies and that they would take care of any late fees and protect my credit. I have printed out all the information concerning the web information given to me by the payment protection insurance to prove that the filing claims information given to me by them is not legimate. I feel like I am being pushed off from filing an unemployment claim.

6/24/2003 12:52:07 PM /VilleladyX / I would like to know some more information on the lawyer who took these cases. I would like to contact him for my mother and I. We have just stumbled onto this website 6-23-03. It seems as though this lawsuit took place in 2000, but there are still people out there that have no clue about what is going on. So, someone please email me and let me know something. CapitalOne charged off my account, but yet the charge off is still revolving. My mother (who is now on disability), is being charged in the same manner. She is also being charged for using the card for getting cash; which she has never done. So, if anyone has any information, please do not hesitate to let me know. Thank You Soooo Much, Jennifer B*/K* England NC

I received a statement with a balance of $650.00.We're in June, 2003 and I am disputing this but there are still charges and fees that keep occuring. This account should have been closed 7 months ago and the balance should have been zero in April!!!! CapitalOne is the worst bank I have ever dealt with. They are greedy liars. Anyone who has a CapitalOne account should cancel it right away or transfer the account to a more reliable bank. Get away from CapitalOne immediately!!!!

5 Jun 2003 04:22:25 /HowDoFind: Web Site search engine /FoundFrom: Ask Jeeves /Ms. Chris M*/ cma*@msn.com /This is not in regard to the class action lawsuit but I would appreciate it if someone could give me a little information regarding my having to default on my CapitalOne unsecured credit cards? I need to know how to proceed if I need to at all. Just a little info on my situation. I am a 50 year old lady on SSI Disability. I had 2 accounts with CapitalOne. One for $7500. and another for $2500. I draw about $500 per month. I was keeping up the best I could on my accounts but major car repairs, food, cleaning products, gasoline for trips to doctors and other unforeseen problems soon raised my limit to where the my payments were less than the interest charged per month. In August of last year, 2002, I went with a Consumer Credit Agency, which I now regret but it seemed like a good idea at the time. They failed to get me a lower payment but said my account would be paid off sooner. They said they got CapOne down to 5% apr. From August to December I paid my account with Debticated on time but my account balances were going higher not lower. The interest was beginning to take over. I called CapitalOne, Debticated said this was up to me, to ask them to re-age my accounts. They would not and they were very rude about it. That is when I finally threw in the towel. Now my accounts have been turned over to a legal firm in Cleveland, Ohio who is bound and determined to take me to court. The attorney handling my case is as rude as the reps in the re-aging dept of CapOne who were the straw that broke this camel's back. This is my question: what can be done to me? What penalties can the court apply to me? I don't have the money now and I won't have it if they take me to court, so what do I do? I do not own a car, I live in subsidized housing, I am on Medicaid, I receive food stamps, I receive assistance on my electric and phone. What can they do to me? Other than going to jail I do not know what they expect from me. I have told them my situation but they are still hellbent on proceeding to file suit against me. Reading some of the complaints from other CapOne account holders I must say I agree with them. They have extremely rude customer reps and they are a very unfeeling organization when it comes to the misfortunes one encounters. I never had to ask for credit with CapitalOne. They sent me a notice saying I was pre-approved and just to check a box. I am sure if they did ask for an "employer" I did put down SSI Disability. But, I don't believe this ever came up. So, am I headed for jail or what? Any help you may give will be greatly appreciated. I have cut back and cut out everything possible just to exist from month to month. I have numerous physical problems and severe depression plus other problems. After the untimely passing of my mother, I had an emotional breakdown and have had a couple of relapses since. I am in chronic pain 24/7 365 days a year due to major back surgery and other related illnesses such as osteoarthritis. All of this with CapitalOne and now the legal firm is just about to cause my last nerve to snap. When I accepted CapitalOne's offers I really thought I would be able to take care of my financial obligations. I did not do this intending to run up my accounts and then default. I truly did not. But, s*** happens and now I find I simply cannot repay my obligations. Any help you may offer will be deeply appreciated. Thank you.
29 May 2003 19:22:57 /Chris B* / b*@cheqnet.net /715-***-****/ Because of a car accident (I am a commissioned based sales person) Our CapitalOne accounts went over due. They then went to a charge off. I finally recovered and received my settlement and wanted to pay off these accounts. I was unable to receive either a return phone call from the recovery service desk (James at ext: 405-61-39) nor from the Attorney's that are handling the case. This has caused us several problems in trying to obtain a car loan which we desperately need. I have called over the past two weeks. My husband has been trying to pay his off for over 3 months. This is an abuse, I have already been through enough, I have been trying to get on with my life and now this happens.
It is strange that the cards balance's got so high as neither my husband nor I were charging anything on these cards and we could not pay them off fast enough. For instants
my Husbands card which I had paid down to less than $150 had a final balance of $700. They say this is late fees but it seems like a great deal of money. I am very disappointed and feel like we are caught in a trap.

If they give me a bad rating and I do lose my job and can't get one in the future or if my father or husband get heart attacks because of this, I will sue them for harassment, since my husband and I didn't know of this litigation beforehand and we have CapitalOne cards right now. I am in the very good position to post this information without blame, as I am involved with the Better Business Bureaus of America, and my sister is a consumer reported for a local affiliate of CBS. She has had bad experiences with these monsters I guess, hasn't everyone, I know they just closed a call center here in my area due to some problems. Its OK, I have heard that some top officials in their organization are in real trouble with some agencies....they (the top officials) will probably to the right thing and commit suicide or be bumped off by a pissed off customer, and gee if I were any of them I would not really be to quick to let people know who you work for.
